Mr. Rosenberg’s practice at Slover & Loftus encompasses a range of matters involving energy and transportation.  Areas of recent activity include:  coal transportation and coal supply matters; railroad rate relief for captive shippers; price adjustments under long-term contracts, including accounting for the effect of productivity; calculation of economic damages; the establishment, construction, and operation of rail-related facilities, including common carrier determinations; and joint ownership/management arrangements for power plants and other facilities.  He also led the efforts that resulted in revision to the Surface Transportation’s Board methodology for calculating the cost of capital for the railroad industry. 

Mr. Rosenberg has also been engaged in matters involving antitrust, including the interplay of antitrust with regulation.  His activities include litigation in state and federal courts (including federal circuit courts of appeal), arbitration, negotiation, drafting, and counseling.

Mr. Rosenberg directs the firm’s energy regulatory practice, where he has been active in representing clients before the Federal Energy Regulatory Commission (FERC), as well as various courts, and has also advised utility clients regarding state regulatory matters, including the interplay between federal and state regulation.  Mr. Rosenberg has been involved in most of the major electric regulatory efforts at FERC for the past fifteen years, including Order No. 888 through more recent revisions of the Open Access Transmission Tariff and the establishment of the binding electric reliability standards.  In addition, he has been actively involved in the California Refund Proceeding, not only at FERC, but also on appeals and in related federal and state trial court litigation involving alleged contract refund claims against non-jurisdictional entities.

After graduating from law school, Mr. Rosenberg served as Legislative Counsel to Congressman Thomas E. Petri
(R-Wisc.) for a year.

Mr. Rosenberg's publications include: Revenue Adequacy (Association Highlights of the Association of Transportation Law Professionals, Jan.-Feb. 2006); Break the Bottleneck: Recent Decisions Ensure That Bottleneck Rates Remain a Problem on the Rails. (Legal Times, August 18, 1997)(co-authored with Kelvin J. Dowd); "Who Wins in a Competitive Power Market: Gas?, Coal?, Or Rail and Mining Interests?" (Public Utilities Fortnightly, April 1, 1997); and "Reducing Coal Transportation Costs" (Public Utilities Fortnightly, October 11, 1990).

Mr. Rosenberg is a frequent speaker on energy and transportation matters such as coal transportation, the extent of FERC regulation over non-jurisdictional entities, and FERC reliability regulation at such forums as the National Coal Transportation Association, the National Rural Electric Cooperative Association, and the Association of Transportation Law Practitioners.
